WatchMyCompetitor.com Ltd (‘WMC’, ‘we’, ‘us’, or ‘our’) provides this website and the services available through it (the ‘Services’) to you subject to these Terms of Service (‘Terms’).
In these Terms, we refer to our platform as the ‘Application’. We refer to the competitive intelligence, monitoring, analytics, and AI-powered features accessible through the Application as the ‘Services’.
Please read these Terms carefully before using the Services. By accessing or using the Services, you agree to be legally bound by these Terms and all policies and guidelines incorporated by reference. If you do not agree with these Terms in their entirety, you may not use the Services.
In these Terms, our customers and the staff members to whom they grant access are called ‘Subscribers’. All people who use the Services are called ‘Users’.
WMC reserves the right to change or modify these Terms at any time at its sole discretion. We will notify you at the email address provided during registration. If you do not agree with any changes, you may cancel your account without further obligation, except for fees due for the remainder of the current billing period. Unless otherwise stated, changes take effect immediately upon posting, and your continued use of the Services constitutes acceptance. The Services are for your own internal business use only. You may not resell, sublicense, or otherwise provide access to the Services to any third party except as expressly permitted through the Application
1. Privacy Policy
Please refer to the WMC Privacy Policy, available at watchmycompetitor.com/privacy, for information on how WMC collects, uses, and discloses personally identifiable information. By using the Services, you agree to our collection and use of information in accordance with the Privacy Policy.
2. Registration Data; Account Security
If you register for an account, you agree to:
- Provide accurate, current, and complete information as prompted by registration forms;
- Maintain the security of your password and not share your login credentials with any other person;
- Promptly update your registration information to keep it accurate and complete; and
- Accept responsibility for all activity that occurs under your account.
You are responsible for all activity on your WMC account and for all charges incurred by your account. If you become aware of any unauthorised use of your account, please notify WMC immediately at support@watchmycompetitor.com.
3. Fees, Charges, and Taxes
Fees and other charges for use of the Services may change from time to time. If we change them, we will give you at least 30 days’ notice. Your continued use of the Services after the effective date of any change constitutes your agreement to the new fees. Fee changes will not apply to the billing period in which the change occurs. You are responsible for all taxes applicable to fees and charges in any relevant jurisdiction.
4. Refund Policy and Service Cancellation
You may terminate your use of the Services and your agreement to these Terms at any time. Upon termination, you remain liable for fees applicable for the balance of the then-current billing period. If your billing period is monthly, we will prorate your account to the nearest month-end after termination.
5. Ownership, Copyright, and Trademarks
All software, systems, data, algorithms, and technology used to create and operate the Services are the property of WMC and are protected by UK and international intellectual property laws. All rights in the Services — including all information, data, logos, marks, designs, graphics, and their selection and arrangement — are expressly reserved by WMC.
6. Licence to Use the Services
WMC grants you a limited, revocable, non-exclusive, non-sublicensable licence to access the Services and to use the Content available to you through the Services for your own internal business purposes. This licence is subject to these Terms and is conditioned upon the following:
- You may only use Content for your own internal business purposes and may not redistribute or commercially exploit it;
- You may not modify or create derivative works of the Content, or reproduce or distribute it except as expressly permitted;
- You may not remove or modify any copyright, trademark, or proprietary notices;
- You may not use data mining, robots, scraping, or similar automated data gathering or extraction methods; and
- You may not use the Services or Content other than for their intended purpose.
Any unauthorised use will terminate this licence immediately and may violate applicable laws, including copyright and trademark laws. This licence is revocable by WMC at any time.
7. Document Uploads
The Services allow Users to upload documents and files (‘Uploaded Content’) for the purpose of AI-assisted analysis and the generation of intelligence responses within the platform.
7.1 Your Responsibility for Uploaded Content You are solely responsible for all Uploaded Content. WMC has no responsibility or liability for any Uploaded Content, or for any loss, damage, or legal exposure arising from it. By uploading content to the Services, you represent and warrant that:
- You have the right to upload the content and to use it in connection with the Services;
- The Uploaded Content does not infringe any intellectual property right, confidentiality obligation, or applicable law; and
- The Uploaded Content does not contain any material that is unlawful, harmful, or otherwise objectionable.
WMC reserves the right to remove any Uploaded Content at any time if it reasonably considers it to be in breach of these Terms or applicable law.
7.2 Use of Uploaded Content Uploaded Content is used solely for the purpose of generating AI-powered responses and analysis within your account. WMC does not use Uploaded Content for any other purpose.
7.3 Privacy of Uploaded Content Uploaded Content is private to your account. It is not shared with any other WMC client, third party, or external system. Uploaded Content is not used to train, fine-tune, or improve any AI or machine learning model, whether operated by WMC or any third party.
7.4 Retention and Deletion Uploaded Content is retained only for as long as necessary to provide the Services to your account, or as required by applicable law. Upon termination of your account, Uploaded Content will be deleted in accordance with WMC’s data retention policies.
8. Artificial Intelligence Features
WMC’s platform includes AI-powered features, including conversational AI agents, AI-generated intelligence summaries, competitive analysis tools, and other machine learning capabilities (collectively, ‘AI Features’).
8.1 Privacy of AI Interactions All queries, questions, and interactions you submit to WMC’s AI Features are treated as strictly confidential. Your prompts, queries, and the outputs generated in response are private to your account and are not shared with any other WMC client, third party, or external system.
8.2 No Use for AI Training WMC does not use your queries, questions, conversations, Uploaded Content, or any other content you submit to AI Features to train, fine-tune, or improve any AI or machine learning model — whether operated by WMC or any third party. Your interactions with WMC’s AI Features are used solely to generate responses for your own use within your account.
8.3 Data Infrastructure WMC uses private, proprietary AI infrastructure designed to ensure that client data remains within a secure, isolated environment.
8.4 Accuracy and Reliance AI-generated outputs are provided for informational and analytical purposes only. While WMC takes care to ensure the quality and accuracy of AI outputs, they should not be relied upon as the sole basis for business decisions. WMC does not warrant that AI-generated content is complete, accurate, or free from error, and excludes all liability for decisions made in sole reliance on AI outputs.
8.5 Acceptable Use of AI Features You agree not to use AI Features to: (i) generate content that is unlawful, misleading, or harmful; (ii) attempt to reverse-engineer, probe, or extract underlying AI model weights or architecture; or (iii) use AI outputs in any way that violates these Terms or applicable law.
9. Providing a Reliable and Secure Service
WMC takes the reliability and security of the Services seriously. We use industry-standard hosting and security technologies designed to protect your data and ensure consistent availability. All data is encrypted in transit using TLS and encrypted at rest, ensuring your information is protected at every stage of processing and storage.
No system is perfectly secure or reliable. The internet is an inherently insecure medium, and the reliability of third-party hosting services and internet intermediaries cannot be guaranteed. By using the Services, you accept these risks.
10. No Responsibility for Third-Party Material
The Services may contain links to third-party websites (‘Third-Party Sites’) or third-party content (‘ThirdParty Content’). Your use of Third-Party Sites and content is at your own risk. WMC makes no representations regarding Third-Party Content and provides links only as a convenience. WMC accepts no responsibility for third-party content, policies, or practices. When you leave the Services, WMC’s terms and policies no longer govern your activity
11. Warranty Disclaimer
The Services and their Content are provided on an ‘as is’ basis without warranties of any kind, express or implied. WMC expressly disclaims all implied warranties, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. WMC does not warrant that the Services are accurate, complete, reliable, current, or error-free.
12. Limitation of Liability; Indemnity
Neither WMC nor any of its affiliates, contractors, officers, directors, agents, or employees (the ‘Released Parties’) shall be liable for any direct, indirect, special, incidental, or consequential damages of any kind — including loss of use, loss of profits, or loss of data — whether arising in contract, tort, or otherwise, arising out of or in any way connected with your use of or inability to use the Services.
In no event shall the aggregate liability of WMC exceed the fees paid by you for the Services during the three months prior to the date of any claim.
You shall defend, indemnify, and hold harmless WMC and the Released Parties from any losses, damages, costs, and expenses (including reasonable legal fees) arising out of your use of the Services, your Uploaded Content, or your breach of these Terms.
13. Communications
Notices from WMC may be delivered by email to the address provided in your Registration Data, by posting to your account dashboard, or by posting on the platform. Notices of amendment to these Terms will be sent by email in accordance with the introduction of these Terms.

14. Applicable Law and Dispute Resolution
The Services are controlled and operated by WMC from its offices in London, United Kingdom. These Terms and any disputes arising from or relating to your use of the Services are governed by the laws of England and Wales.
Any claim, dispute, or controversy arising out of or relating to these Terms or the Services will be referred to and determined by a sole arbitrator under the commercial arbitration laws of England and Wales in effect at the time of the notice, to the exclusion of the courts, except where prohibited by applicable law.
Where arbitration is not available, disputes will be resolved in a court of competent jurisdiction in England and Wales. If you access the Services from outside the United Kingdom, you are responsible for compliance with all applicable local laws.
15. Termination and Modification of Services
(a) Terminate your licence to use the Services or any portion thereof; (b) Block or prevent your future access to the Services; (c) Change, suspend, or discontinue any aspect of the Services; and (d) Impose limits on the Services or Content.
16. Inactive Accounts; Termination
If your account is inactive for at least two months, WMC may deactivate it. If it remains inactive thereafter, WMC may terminate it at any time without notice, including deletion of all associated content and Uploaded Content.
Either party may terminate your use of the Services at any time. Upon termination, fees remain due for the balance of the current billing period.
Sections 4, 7, 8, 9, 11, 12, 13, 15, and 16 survive termination or expiry of these Terms.
17. Miscellaneous
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and shall not affect the validity of the remaining provisions. WMC may assign any of its rights under these Terms without your consent. You may not assign your rights or obligations without WMC’s prior written consent.
These Terms constitute the entire agreement between you and WMC regarding your use of the Services, and supersede all prior communications or agreements. These Terms are drawn up in the English language only.
